Terms of Sale

1. Who you are dealing with

AGX Drone Distributors is a registered business name of Propulsion Ag Pty Ltd, ABN 15 685 071 514, of Horsham, Victoria (“AGX”, “we”, “us”). In these terms “you” means the person or business placing the order.

2. What these terms cover

These terms apply together with our Shipping & Delivery and Returns & Warranty policies, which form part of the agreement between us. Where a signed quote or supply agreement says something different, that document wins over these terms for that order.

3. Prices and GST

All prices are in Australian dollars and include GST at 10 per cent. Shipping rates include GST too. GST is never added on top at checkout: your tax invoice simply itemises the GST component already contained in the price. Prices can change without notice, but a change never affects an order we have already accepted.

We try hard to keep the catalogue accurate. If a product is listed at an obviously wrong price or with a materially wrong description, we are not required to supply it at that price. If that happens after you have paid, we will contact you, and you can confirm the order at the corrected price or receive a full refund. It is your choice, not ours.

4. Two ways to order

Online checkout. Spare parts, accessories, training and similar items can be added to the cart and paid for by card. Prices are confirmed on our server when you check out, so the amount charged always comes from our catalogue rather than from your browser.

By quote. Aircraft, spreading systems, chemical mixers, generators, docks, lithium flight batteries and anything priced at or above $20,000 are sold on quote rather than through the cart. Freight, configuration and lead time vary too much on this equipment to publish a single price. Request a quote and we will confirm everything in writing before you commit.

5. When a contract is formed

A listing on this site is an invitation to treat, not an offer. Your order is an offer to buy. Placing an order online and receiving an automatic acknowledgement does not, by itself, form a contract.

A contract is formed only when we accept your order, which happens when we dispatch the goods, or when we confirm acceptance in writing, whichever comes first. We may decline an order, for example where stock is unavailable, where a pricing or description error has occurred, where we cannot deliver to your address, or where we are not satisfied the equipment can be operated lawfully (see clause 11). If we decline, we refund you in full.

6. Payment

Online orders are paid by card through Stripe, our payment processor. Your card details are entered on Stripe's secure checkout and are never seen or stored by us. Quoted orders are paid by electronic transfer or by arrangement, as set out on the quote.

Goods are not dispatched, and equipment is not released, until payment has cleared in full unless we have agreed otherwise in writing.

7. Delivery, title and risk

Shipping is charged as set out in our Shipping & Delivery policy: drones ship free anywhere in Australia, parts ship at a flat rate from $15 depending on the size of the item, and pallet freight and flight batteries are quoted per order. Your cart is charged one shipping fee, at the rate of the largest class it contains.

Risk in the goods passes to you on delivery to the address you gave us. Title stays with us until we have received payment in full. Until then you must keep the goods safe, identifiable and insured.

Please check your delivery on arrival. If anything arrives damaged or is missing, tell us within 7 days so we can lodge a claim with the carrier while that is still possible. Note the damage on the consignment note where you can, and keep the packaging until the claim is finished.

8. Returns and change of mind

We accept change-of-mind returns on spare parts and accessories within 30 days of delivery, provided the item is unopened, unused and in its original packaging with proof of purchase. Refunds go back to the original payment method once the item arrives and is checked, less the original shipping charge. Return postage is at your cost.

Change-of-mind returns are not available on special-order and indent items brought in specifically for you, on lithium flight batteries, or on opened software licences and training products. The full policy, including how to start a return, is on our Returns & Warranty page. None of this affects your rights under clause 9.

9. Your Australian Consumer Law rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

These guarantees apply automatically and sit alongside, not instead of, any manufacturer warranty. Nothing in these terms limits, excludes or modifies them, and if any part of these terms would have that effect, that part does not apply.

10. Manufacturer warranty

Equipment we sell carries the relevant manufacturer's Australian warranty. Warranty periods and what they cover are set by the manufacturer and vary by product, so check the documentation supplied with your equipment. As the dealer we lodge and manage warranty claims on your behalf rather than sending you to the manufacturer.

Warranty does not cover fair wear and tear, consumables, crash and impact damage, corrosion or chemical damage from incorrect flushing, unauthorised repairs or modifications, or operation outside the manufacturer's published limits.

11. Licensing and safe operation

Agricultural spray aircraft are regulated. Before operating equipment bought from us you are responsible for holding whatever CASA approvals your operation requires, which for the medium category aircraft we sell generally means a Remote Pilot Licence and a type rating, plus an operator's certificate if you fly for anyone other than yourself. Applying agricultural chemicals is separately regulated by your state, with its own licences.

We will help you work through all of that, and we sell a licensing support service, but obtaining and holding the approvals is your responsibility, not ours. You are also responsible for operating the equipment safely and in accordance with the manufacturer's manual, for any chemical you apply, and for the conditions you choose to fly in. We are not liable for penalties, losses or damage arising from unlicensed, unsafe or non-compliant operation.

12. Training, demo days and digital products

Bookings for training and demo days are for the date and place confirmed with you. If you need to move a booking, give us reasonable notice and we will do our best to fit you in elsewhere. We may reschedule a session for weather, safety, or if a presenter becomes unavailable, and where we do you can take the new date or a full refund.

Digital guides and course access are licensed to you for your own use. Please do not redistribute or resell them.

13. Liability

Subject always to clause 9, and to the extent the law allows, our liability for any claim connected with goods or services we supply is limited to, at our option, replacing or repairing the goods, resupplying the services, or refunding what you paid for them.

Again subject to clause 9, we are not liable for indirect or consequential loss, or for loss of profit, crop, contract or business opportunity. Nothing here limits liability that cannot be limited by law.

14. Privacy

We handle the information you give us in accordance with our Privacy Policy.

15. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the version published when we accepted it, so a later change never alters an order already on foot.

16. Governing law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction. If any provision turns out to be unenforceable, the rest keeps operating.
